This website is operated by PocketBook International SA (Lugano, Switzerland), the creator and manufacturer of InkPoster devices and the InkPoster mobile application, and Pocketbook US, Inc. (Dover, Delaware), the importer and distributor of InkPoster products and, where stated at checkout, the seller of InkPoster devices purchased via this website. PocketBook International SA and Pocketbook US, Inc. are together referred to in these Terms as “PocketBook”. Throughout the site, the terms “we”, “us” and “our” refer to PocketBook and its affiliates.

PocketBook offers this website, including all information, tools and services available from this site, to you on the condition that you accept all terms, conditions, policies and notices stated here.

By visiting our website, purchasing or using InkPoster devices, or using the InkPoster mobile application, you agree to be bound by these Terms of Use, including any additional terms and policies referenced here.

Our website is hosted on Shopify Inc. Shopify provides the ecommerce platform that allows us to sell products and services to you. These Terms are based on Shopify’s template and adapted by us.

SECTION 1. GENERAL TERMS

By agreeing to these Terms, you confirm that you are at least 18 years old or the age of majority in your country of residence.

You must not use our products or services for any unlawful purpose or violate applicable laws.

A breach of these Terms may result in immediate termination of your access to the Services.

SECTION 2. ORDER AND PURCHASE

Each InkPoster is designed to work with the InkPoster mobile application and the cloud based Art Gallery.

A contract is formed when you complete checkout and submit payment.

You will receive an order confirmation email once your order is placed successfully.

SECTION 3. PRICES AND SHIPPING

Prices and applicable taxes are shown at checkout. Shipping costs are displayed before you place your order.

For UK customers, prices are shown in GBP and include VAT where applicable.

Risk of loss passes to you once the product is delivered to your nominated address.

SECTION 4. PAYMENT

We accept payment methods shown at checkout, including major cards, Shop Pay, Apple Pay, Google Pay and PayPal.

Payment is processed securely through Shopify Payments or the selected payment provider.

SECTION 5. PRODUCT AVAILABILITY AND DESCRIPTIONS

Product images and descriptions are provided for illustration purposes. Minor variations may occur.

Returns for purchases made on this website are governed by our Return and Refund Policy.

SECTION 6. ACCURACY OF BILLING AND ACCOUNT INFORMATION

You agree to provide accurate and complete purchase and account information.

SECTION 7. INKPOSTER APP ACCOUNT

Use of the InkPoster device requires installation of the InkPoster mobile application and creation of an InkPoster account.

Use of the application is governed by the Terms presented within the app.

SECTION 8. RIGHT OF USE FOR ART GALLERY CONTENT

Art Gallery content is licensed for personal display on registered InkPoster devices only.

Commercial use, redistribution or resale of content is not permitted.

SECTION 9. OPTIONAL TOOLS

Third party tools are provided as is. Use is at your own risk.

SECTION 10. THIRD PARTY LINKS

We are not responsible for third party websites or their content.

SECTION 11. USER COMMENTS AND SUBMISSIONS

You agree that we may use feedback or submissions without restriction.

SECTION 12. PERSONAL INFORMATION

Personal information submitted through the website is governed by our Privacy Notice.

SECTION 13. ERRORS AND OMISSIONS

We reserve the right to correct errors or inaccuracies at any time.

These Terms are governed by the laws of England and Wales.

We may update these Terms from time to time by posting changes on this page.
